No Liability for AI Content: CaptionFuel shall not be liable for any damages, losses, or claims arising from your use of AI-generated content, including but not limited to: defamation, copyright infringement, privacy violations, business losses, or any other harm resulting from AI-generated content.

10. Third-Party Services and Data

The Service relies on third-party services and data sources, including but not limited to:

• AI model providers (OpenRouter, OpenAI, Anthropic, DeepSeek, etc.)
• Payment processors (Stripe)
• Database and hosting services (Supabase, Vercel)
• Platform insights APIs (RapidAPI, various social media APIs)
• Email services (Resend)

Third-Party Disclaimers: We are not responsible for the availability, accuracy, or reliability of third-party services or data. We do not guarantee that third-party services will be available, accurate, or free from errors. We are not liable for any issues, outages, or problems with third-party services. Platform insights data may be inaccurate, outdated, incomplete, or unavailable. We do not guarantee the accuracy of trending data, hashtag suggestions, or platform insights.

11. Limitation of Liability

To the maximum extent permitted by law, CaptionFuel, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities
• Loss of goodwill or reputation
• Costs of substitute services
• Damages resulting from missing features, incomplete features, or feature changes
• Damages resulting from AI-generated content errors or inaccuracies
• Damages resulting from third-party service failures or data inaccuracies
• Damages resulting from service interruptions or unavailability
• Any other damages arising from your use or inability to use the Service

Maximum Liability: Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater. This limitation applies regardless of the legal theory on which the claim is based.

13. Indemnification

You agree to indemnify, defend, and hold harmless CaptionFuel and its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your use of AI-generated content
• Any content you create, post, or share using the Service
• Your infringement of any intellectual property or other rights of any person or entity

14. Force Majeure

CaptionFuel shall not be liable for any failure or delay in performance under these Terms which is due to causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network or internet failures, third-party service failures, strikes, shortages of transportation facilities, fuel, energy, labor, or materials, or any other causes beyond our reasonable control.

15. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination:

• Your right to use the Service will cease immediately
• We may delete your account and associated data
• You will not be entitled to any refund of prepaid fees

16. Limitation Period
